SOCIAL SECURITY SCHEME – II (SSS-II)
(PERSONAL ACCIDENT COVERING DEATH AND HOSPITALIZATION)
Framed in the Meeting held on 10-11-2017
A Scheme formulated by the Kerala High Court Advocates’ Welfare Fund Trust for rendering financial benefits to the members of the Trust and their family, in exercise of the powers conferred to the Trust as per clause XIV of the Deed of Trust.
- Aims & Objectives:
In addition to the general aims and objectives of the Kerala High Court Advocates’ Welfare Fund Trust
(hereinafter referred to as the ‘Welfare Fund Trust’ or ‘The Trust’,)
the Social Security Scheme-II has the following aims and objectives
- The primary objective of the Scheme is to give financial support to the bereaved family of a member of the Trust in the event of his/her death in any kind of accidents.
- To render financial assistance to the members of the Trust in case of hospitalization as a result of sustaining bodily injury in any kind of accident.
- The benefit of the scheme is in the nature of personal accident insurance and the purpose is to pay fixed compensation for death or assistance for hospitalization expenses due to such injury.
- The Scheme provides financial assistance for accidents caused by external, violent, and visible means,
resulting in death or hospitalization, subject to the other conditions provided herein.
- An accident means an event which is wholly unexpected and not intended or designed.
- Hospitalization means admission in a hospital as an inpatient for a period of more than 10 days.
- Membership:
- A member of the Welfare Fund Trust, irrespective of age, is covered under this scheme (SSS-II).
- For this Scheme, a ‘member’ means a person admitted by the Board of Trustees as a donor member, life member, or ordinary member.
- Benefits & Eligibility for benefits of the Scheme:
Members are eligible for benefits under the following conditions:
- No additional subscription or fee is required.
- Legal heirs or nominees of a deceased eligible member due to an accident will receive Rs. 5,00,000.
- Financial assistance up to Rs. 2,00,000 may be given if hospitalization expenses exceed Rs. 50,000 due to accident-related injuries.
- If the member dies after receiving hospitalization benefit under 3(c), it will be deducted from the death benefit under 3(b).
- Benefits from Social Security Scheme I and II cannot be availed simultaneously. The higher benefit will be granted if not specified.
- Any disputes will be resolved by the Board of Trustees and their decision will be final.
- Subscription: No subscription is required for members to enjoy benefits under this Scheme.
- Cessation from membership: A member ceases to be part of this Scheme upon:
- Resignation in writing;
- Removal from the State Bar Council roll;
- Suspension of practice due to employment or other avocation;
- Removal from Kerala High Court Advocates’ Association membership.
10. Termination of Membership:
Membership may be terminated by the Board of Trustees for valid reasons recorded in writing.
Provided that, no termination shall occur without a hearing opportunity before the Board or a sub-committee.
The decision must be approved by the General Body before implementation.
- Amendment: Amendments may be proposed by a 2/3 majority of the Trustees present at a meeting convened for that purpose, in accordance with the Trust Deed.
- Special Powers of Board of Trustees:
The Board may revise benefit amounts based on financial stability and functionality, subject to approval by the General Body.
Provided that the amounts shall not exceed the limits set in clause 3(b) and 3(d).
- Association with Financial Institutions:
With General Body approval, the Board may associate with financial/institutional bodies to manage the scheme.
10. This Scheme shall be managed by the Board of Trustees and shall come into force at once.
